Force Majeure

Pixel Craft shall not be liable for any failure or delay in performance of our obligations under these Terms and Conditions arising from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government actions, internet service provider failures, power outages, equipment failures, pandemics, or other similar events. Upon occurrence of a force majeure event, we will make reasonable efforts to minimize its impact and resume normal operations as soon as practicable.

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference. Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without giving effect to any principles of conflicts of law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these terms.

Exclusive Jurisdiction

You agree that any legal action or proceeding arising from or related to these Terms and Conditions or your use of our services shall be brought exclusively in the competent courts of Nicosia, Cyprus. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue in such courts based on inconvenient forum or otherwise.

Dispute Resolution Procedures

Informal Resolution

Before initiating any formal legal proceedings, we encourage you to contact us to attempt to resolve any disputes informally. Most concerns can be addressed through good-faith discussions. Please send a detailed description of the dispute to info@domain.com, and we will work with you to find a mutually acceptable resolution.

Mediation

If informal resolution attempts fail, both parties agree to participate in mediation before pursuing litigation. Mediation shall be conducted by a mutually agreed-upon neutral third party in Nicosia, Cyprus. The costs of mediation shall be shared equally between the parties unless otherwise agreed. Any mediation proceedings shall be confidential.

Time Limitations

Any cause of action or claim you may have arising out of or relating to these Terms and Conditions or our services must be commenced within one year after the claim or cause of action arises. After this period, such causes of action or claims are permanently barred.

Severability Clause

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent, or if such modification is not possible, it shall be deleted entirely.

Waiver

No waiver by Pixel Craft of any term or condition set forth in these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by Pixel Craft to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision. All waivers must be in writing and signed by an authorized representative of Pixel Craft.

Assignment

You may not assign or transfer these Terms and Conditions or any rights or obligations hereunder without our prior written consent. Any attempted assignment without such consent shall be null and void. Pixel Craft may freely assign these Terms and Conditions and our rights and obligations hereunder, in whole or in part, without notice or your consent, including in connection with a merger, acquisition, reorganization, or sale of assets.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Cookie Policy, and any other legal notices or policies published on our website, constitute the entire agreement between you and Pixel Craft regarding your use of our services and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Pixel Craft.

Survival

All provisions of these Terms and Conditions that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, limitations of liability, dispute resolution provisions, and governing law clauses.

Language

These Terms and Conditions are written in English. Although translations may be provided for convenience, the English version shall prevail in case of any discrepancy or conflicting interpretation between the English version and any translation.

Modification of Terms

Pixel Craft reserves the right to modify, amend, or update these Terms and Conditions at any time at our sole discretion. Changes become effective immediately upon posting to our website unless otherwise specified. Material changes will be indicated prominently. Your continued use of our services after any modifications constitutes acceptance of the revised Terms and Conditions.
